YMCA Internet & Wifi Use Policy

This Policy is a guide to the acceptable use of The Island of Hawai’i YMCA dba Island of Hawai’i YMCA’s (hereinafter YMCA) Free Wi-Fi services. Any individual connected to YMCA’s Wi-Fi Guest network in order to use it directly, or to connect to any other network(s), must comply with this policy and the stated purposes and Acceptable Use policies of any other network(s) or host(s) used. The following guidelines will be applied to determine whether a particular use of the Services is appropriate:

  1. Users must respect the privacy of others. Users shall not intentionally seek information on, or represent themselves as, another user unless explicitly authorized to do so by that user. Nor shall Users obtain copies of, or modify files, other data, or passwords belonging to others.
  2. Users must respect the legal protection applied to programs, data, photographs, music, written documents and other material as provided by copyright, trademark, patent, licensure and other proprietary rights mechanisms.
  3. Users must respect the integrity of other public or private computing and network systems. Users shall not intentionally develop or use programs that harass other users or infiltrate any other computer, computing system or network and/or damage or alter the software components or file systems of a computer, computing system or network.
  4. Use should be consistent with guiding ethical statements and accepted community standards. Use of the Services for malicious, fraudulent, or unrepresentative purposes is not acceptable.
  5. The Services may not be used in ways that violate applicable laws or regulations.
  6. Users agree to:
    1. Not upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable.
    2. Not harm minors in any way.
    3. Not impersonating any person or entity, including, but not limited to, a YMCA official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;
    4. Not forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted.
    5. Not transmit any content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements.
    6. Not transmit any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party.
    7. Not transmit any unsolicited or unauthorized advertising, promotional materials “junk mail” “spam” “chain letters” “pyramid schemes” or any other form of solicitation.
    8. Not transmit any content that contains software viruses or any other computer code files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
    9. Not disrupt the normal flow of dialogue, cause a screen to “scroll” faster than other users are able to or otherwise act in a manner that negatively affects other users’ ability to engage in real time exchanges.
    10. Not interfere with or disrupt servers or networks, or disobey any requirements, procedures, policies or regulations of networks.
    11. Not relay email from a third party’s mail servers without the permission of that third party.  Not use “robots” or otherwise harvesting other’s email addresses from the YMCA site for purposes of sending unsolicited or unauthorized material.
    12. Not upload, post, email, or transmit the same message, URL, or post multiple times.  Not intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law.
    13. Not “stalk” or otherwise harass another; or not collect or store personal data about other users
  7. The Services may not be used in a manner that precludes or significantly hampers network access by others. Nor may the Services be used in a manner that significantly impairs access to other networks connected to the YMCA’s Wi-Fi network.
  8. Connections which create routing patterns that are inconsistent with the effective and shared use of the Services may not be established.
  9. Unsolicited advertising is not acceptable. Advertising is permitted on some Web pages, mailing lists, news groups and similar environments if advertising is explicitly allowed in that environment.
  10. Repeated, unsolicited and/or unwanted communication of an intrusive nature is strictly prohibited. Continuing to send e-mail messages or other communications to an individual or organization after being asked to stop is not acceptable.
  11. By logging on, you agree to hold the YMCA harmless for any damage that may result from access to the Internet or inappropriate usage.

The intent of this policy is to identify certain types of uses that are not appropriate, but this policy does not necessarily enumerate all possible inappropriate uses. Using the guidelines given above, we may at any time decide that a particular use is not appropriate.
